Yes. You and your friend could be criminally charged. Fraud, embezzlement, theft by deception . . . but it would depend on how your state defines each crime before I could predict which one you would be charged with. In addition to the felony charge, you would also be charged with theft. The theft charge could be a misdemeanor or a felony depending on the dollar threshold imposed by your state.
